Yours Engineer Home Solutions is a marketplace platform for household service providers and enables the connection between individuals seeking to obtain services (“customer”) and/or individuals seeking to provide services (“service provider”). Customer and service provider together are hereinafter referred to as “users” and individually as “user”. Those certain services requested by the customer, which are to be completed by the service provider, are hereinafter referred to as “services”.

• General Provisions

  Yours Engineer Home Solutions takes no responsibility for money paid to service provider without informing us. Yours Engineer Home Solutions has no control over payments made in cash to service provider.

  We discourage any tips or reward to any of our service provider however if any customer is doing so is completely based on their own will and decision.

  Service provider is liable for any damage by him, in occurrence of any such event the customer is requested first contact Yours Engineer Home Solutions customer care and then may lodge a complaint against the service provider, if the solution is resolved amicably.

  Yours Engineer Home Solutions may decline to arrange service providers on national holidays, public holidays, government holidays without any obligation to any customer or user.

  Customers are requested to report/inform us immediately for any misconduct or unsatisfied behavior of any of service provider so that Yours Engineer Home Solutionsn can take action for improvement. However if the misconduct is falling in the category of breach of law then customer may deal with that as per the applicable laws directly with the service provider and Yours Engineer Home Solutions will not be responsible in such case.

  Also, in case any criminal act is committed by the service provider while providing services, the customer, at its own will can take direct action under the laws of country and also keep us informed on full details of the same. Yours Engineer Home Solutions will not be party to any such action

• Yours Personal Information

  Yours Engineer Home Solutions has limited control over the quality, timing or legality of services delivered by service provider. Yours Engineer Home Solutions makes only a sincere attempt to provide best service providers and hence does not take full responsibility of suitability, reliability, timeliness, or accuracy of the services requested and provided by users. Although Yours Engineer Home Solutions does perform background checks of service provider, Yours Engineer Home Solutions cannot confirm that each user is who they claim to be. Yours Engineer Home Solutions does not assume any responsibility for the accuracy or reliability of this information or any information on the service.

  Neither Yours Engineer Home Solutions nor its affiliates or licensors is responsible for the conduct, whether online or offline, of any user of the service. Yours Engineer Home Solutions and its affiliates and licensors will not be liable for any claim, injury or damage arising in connection with Yours use of the service.

• Eligibility To Use

  The services are not available to minors under the age of eighteen (18) or to any users suspended or removed from the Yours Engineer Home Solutions system by Yours Engineer Home Solutions for any reason whatsoever. If you are disqualified as per the preceding sentence, you shall not be permitted to avail of the services or use the website. You represent that you are of legal age to form a binding contract and are not a person barred from receiving the services under the laws as applicable in india. Notwithstanding the foregoing, if you are below the age of eighteen (18) years, please read through these terms of use with Yours parent or legal guardian, and in such a case these terms of use shall be deemed to be a contract between Yours Engineer Home Solutions and Yours legal guardian or parent and to the extent permissible under applicable laws, enforceable against you.

  Yours Engineer Home Solutions reserves the right to refuse access to use the services offered at the website to new users or to terminate access granted to existing users at any time without according any reasons for doing so.

  Customer is advised not to directly contact service providers regarding an order booked through Yours Engineer Home Solutions. All warranties offered by Yours Engineer Home Solutions stands null & void in such cases.

  For any kind of major dispute or disagreement between customer and service provider, Yours Engineer Home Solutions 's supervisor will inspect and his decision will be final regarding the scope of rework.

  In any case, overall rework value will not go beyond the service charges paid by the customer. Yours Engineer Home Solutions 's discretion will be final for the rework amount.

• Use Of Content

  Except as expressly indicated to the contrary in any applicable additional service terms, Yours Engineer Home Solutions hereby grants you a non-exclusive, revocable and non-transferable right to view, download and print product catalogues available on the website, subject to the following conditions:

  1. You may access and use the product catalogues solely for personal, informational, and internal purposes, in accordance with these terms of use,
  2. You may not modify or alter product catalogues available on the website,
  3. You may not distribute or sell, rent, lease, license or otherwise make the product catalogues available on the website available to others, and

• Transactions
  Customer offer service payments for each requested service. Three days after a service is scheduled, if there is no complaint by the customer, the agreed upon payment will be transferred to the service provider. The service payment must be paid through the Yours Engineer Home Solutions web services to the extent possible. Any service payments paid in cash outside of the Yours Engineer Home Solutions web service are not subject to refunds.
• Account, Password And Security

  In the event you register as a user by creating an account in order to avail of the services provided by the website, you will be responsible for maintaining the confidentiality and security of the account information, and are fully responsible for all activities that occur under Yours account. You agree to (a) immediately notify Yours Engineer Home Solutions of any unauthorized use of Yours account information or any other breach of security, and (b) ensure that you exit from Yours account at the end of each session. Yours Engineer Home Solutions cannot and will not be liable for any loss or damage arising from Yours failure to comply with this section. You may be held liable for losses incurred by Yours Engineer Home Solutions or any other user of or visitor to the website due to authorized or unauthorized use of Yours account as a result of Yours failure in keeping Yours account information secure and confidential.

• Billing And Payment Policy

  Customers are obligated to pay for the services and applicable government taxes, unless specifically notified otherwise in terms of discount or free service or promotional service. Customers can pay using internet banking and/or credit/debit cards (“bank account”) through Yours Engineer Home Solutions’s payment gateway partners or could just pay the Yours Engineer Home Solutions service provider in cash after the service is completed. Customer can also pay at the end of a completed service transaction. For all purchases and payments for reimbursement costs, fees or expenses associated with a service, Yours Engineer Home Solutions or service provider will charge Yours bank account according to the amount agreed upon between you and Yours Engineer Home Solutions for the use of the service. Yours Engineer Home Solutions and / or service provider retains the right, in its sole discretion, to place a hold on any payment for a completed service transaction.

  At Yours Engineer Home Solutions and service provider's discretion, refunds or credits may be granted in extenuating circumstances, as a result of specific refund guarantee promotions, or to correct any errors made by Yours Engineer Home Solutions.

  While Yours Engineer Home Solutions will use commercially reasonable efforts to ensure the security of all banking and other personal information, we expressly disclaim any liability for any damage that may result should any information be released to any third parties, and you agree to hold Yours Engineer Home Solutions harmless for any damages that may result therefrom. Yours Engineer Home Solutions will use third party services to process banking information. For further information regarding that services, please contact Yours Engineer Home Solutions to request information about Yours Engineer Home Solutions's internet banking and other cashless transaction providers.

  You will be liable for all transaction taxes on the services provided under this agreement (other than taxes based on Yours Engineer Home Solutions's income) as per applicable government norms.

• Termination And Suspension

  Without limitation, Yours Engineer Home Solutions may terminate or suspend Yours right to use the service if you breach any term of this agreement or any policy of Yours Engineer Home Solutions posted on the service from time to time, or if Yours Engineer Home Solutions otherwise finds that you have engaged in inappropriate and/or offensive behavior. If Yours Engineer Home Solutions terminates or suspends Yours right to use the service for any of these reasons, you will not be entitled to any refund of unused balance in Yours account. In addition to terminating or suspending Yours account, Yours Engineer Home Solutions reserves the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

  Yours Engineer Home Solutions may terminate or suspend Yours right to use the service at anytime for any or no reason by providing you with written or email notice of such termination, and termination will be effective immediately upon delivery of such notice. Even after Yours right to use the service is terminated or suspended, this agreement will remain enforceable against you.

  You may terminate this agreement at any time by ceasing all use of the service. All sections which by their nature should survive the expiration or termination of this agreement shall continue in full force and effect subsequent to and notwithstanding the expiration or termination of this agreement.

• Intellectual Property Rights

  All text, graphics, editorial content, data, formatting, graphs, designs, html, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces and other content (collectively “proprietary material”) that users see or read on the service is owned by Yours Engineer Home Solutions or are used by permission. Proprietary material is protected in all forms, media and technologies now known or hereinafter developed. Yours Engineer Home Solutions owns all proprietary material as well as the coordination, selection, arrangement and enhancement of such proprietary materials as a collective work under the intellectual property rights act, as amended. The proprietary material protected by the domestic and international laws of copyright, patents, and other proprietary rights and laws. Users may not copy, download, use, redesign, reconfigure, or retransmit anything from the service without Yours Engineer Home Solutions's express prior written consent. Any use of such proprietary material, other than as permitted therein, is expressly prohibited without the prior permission of Yours Engineer Home Solutions and/or the relevant right holder.

  The service marks and trademarks of Yours Engineer Home Solutions, including without limitation Yours Engineer Home Solutions and the Yours Engineer Home Solutions logo are service marks owned by Yours Engineer Home Solutions. Any other trademarks, service marks, logos and/or trade names appearing on the service are the property of their respective owners. You may not copy or use any of these marks, logos or trade names without the express prior written consent of the owner.

• Confidential Information
  You acknowledge that confidential information (as hereinafter defined) is a valuable, special and unique asset of Yours Engineer Home Solutions and agree that you will not disclose, transfer, use (or seek to induce others to disclose, transfer or use) any confidential information for any purpose other than disclosure to Yours authorized employees and agents who are bound to maintain the confidentiality of confidential information. You shall promptly notify Yours Engineer Home Solutions in writing of any circumstances which may constitute unauthorized disclosure, transfer, or use of confidential information. You shall use best efforts to protect confidential information from unauthorized disclosure, transfer or use. You shall return all originals and any copies of any and all materials containing confidential information to Yours Engineer Home Solutions upon termination of this agreement for any reason whatsoever. The term “confidential information” shall mean any and all of Yours Engineer Home Solutions's trade secrets, confidential and proprietary information and all other information and data of Yours Engineer Home Solutions that is not generally known to the public or other third parties who could derive value, economic or otherwise, from its use or disclosure. Confidential information shall be deemed to include technical data, know-how, research, product plans, products, services, customers, markets, software, developments, inventions, processes, formulas, technology, designs, drawings, engineering, hardware configuration information, marketing, finances or other business information disclosed directly or indirectly in writing, orally or by drawings or observation.
• Modifications To The Service
  Yours Engineer Home Solutions reserves the right in its sole discretion to review, improve, modify or discontinue, temporarily or permanently, the service or any content or information on the service with or without notice. Yours Engineer Home Solutions will not be liable to any party for any modification or discontinuance of the service.
• Indemnification
  You hereby agree to indemnify, defend, and hold harmless Yours Engineer Home Solutions, its directors, officers, employees, agents, licensors, attorneys, independent contractors, providers, subsidiaries, and affiliates from and against any and all claim, loss, expense or demand of liability, including attorneys' fees and costs incurred, arising from Yours use or inability to use the services.
• Dispute Resolution And Governing Law

  In case of any dispute between the users and Yours Engineer Home Solutions, the parties agree to resolve the matter amicably vide arbitration under the indian arbitration & conciliation act, 1996.The language of the arbitration shall be english. Special promotions Yours Engineer Home Solutions may from time to time provide certain promotional opportunities to customer. All promotions will be run at the sole discretion of Yours Engineer Home Solutions, and can be activated, modified or removed at anytime by Yours Engineer Home Solutions without advance notification.

  In the event that you are given a code by or on behalf of Yours Engineer Home Solutions through which you may refer a friend to Yours Engineer Home Solutions in exchange for a referral credit, you shall not use any online marketing or advertising to promote such code or to artificially increase the amount of credits awarded. By way of example, you may not post, or cause, request or permit a third party to post any such code on a coupon website, nor use any paid search marketing, online advertising, forum posting, newsgroup posting or bulk email to disseminate such code. You may only share such code with Yours personal friends and acquaintances for legitimate referral purposes, as determined by Yours Engineer Home Solutions in its sole discretion. Without limiting Yours Engineer Home Solutions's other rights and remedies, Yours Engineer Home Solutions may terminate such code and/or Yours account for any breach of this section.

Customers can rescheduled or cancel the service request anytime online through Yours Engineer Home Solutions Mobile App in 'My Orders' section or using the 'Track Order' link sent in the booking SMS.

If service request is canceled or rescheduled before the cancellation time limit, then the cancellation charges will NOT be applicable.

If service request is canceled or rescheduled after the cancellation time limit, then the cancellation charges will be applicable.

If the service provider is running late by 30 minutes and customer wants to cancel the service request, then the cancellation charges will NOT be applicable.

Yours Engineer Home Solutions reserves the right to cancel any service request at any point of time and will not be liable to anyone for the same.

In case the service request is canceled by Yours Engineer Home Solutions, then customer is NOT liable to pay cancellation charges.

Rework Policy is only applicable for service issues related to workmanship. If there is any problem with spare parts or material, same will not be covered under Rework Policy.

Any kind of functional issue reported within warranty period post completion of work will be inspected by the service provider and if workmanship issue is identified, rework will be provided without any additional cost.

For any issue reported post the warranty period, the same needs to be booked as a fresh order and standard charges will be applicable.

For any extended warranties, please talk to service providers directly. Please insist for the warranty in writing from service provider. Yours Engineer Home Solutions will not be responsible for such extended warranties.

Customers are advised to procure the spare parts themselves. However if service provider procures material or spare parts on customer’s request, please insist on material bill. Yours Engineer Home Solutions will not be responsible for any issues, defects and quality of such material.

If the service provider is asked to do any job which is beyond his technical expertise or scope of work, no rework will be encouraged for the same.

Customer is advised not to directly contact service providers regarding an order booked through Yours Engineer Home Solutions. All warranties offered by Yours Engineer Home Solutions stands null & void in such cases.
